4 Recent legislations
(1) Act to Amend Part of the Penal Code (Act No. 54 of 2007)
This Act, enforced since June 12, 2007 excluding part of its provisions, in order to implement sentencing according to the actual conditions of each case, has the following contents against accidents causing injury or death by vehicle driving; first, to establish a new offense of Vehicle Driving Causing Death or Injury through Negligence, and its statutory sentence shall be imprisonment with/without work for 7 years or less, or fines of 1 million yen or less; and second, vehicles subject to dangerous driving causing death or injury shall be revised to only motor vehicles from 4-wheeled motor vehicles, and 2-wheeled vehicles shall also be covered.
(2) Act for Partial Amendment to the Road Traffic Act (Act No. 90 of 2007)
This Act, enforced since September 19, 2007 excluding part of its provisions, in order to promote appropriate countermeasures against vicious/dangerous driving, etc., such as drunk driving and hit-and-run cases, has the following contents, etc.,: first, to raise the statutory penalty of driving while intoxicated from imprisonment with work for 3 years or less or fines of 500,000 yen or less to imprisonment with work for 5 years or less or fines of 1 million yen or less; second, to establish special penalties against vicious actions in aiding drunk driving (offering of vehicles, etc. or alcohol, action of getting into the same vehicle); and third, to raise the statutory penalty of breach of duty to carry out first-aid (so-called, “hit-and-run”) from imprisonment with work for 5 years or less or fines of 500,000 yen or less to imprisonment with work for 10 years or less or fines of 1 million yen or less.
