2 Trend of cases to be covered by Saiban-in trials Table 6-5-5-2 shows the number of persons finally disposed in the first instance for cases to be covered by Saiban-in trials, by type of offense, over the last four years.
Table 6-5-5-2 Number of persons finally disposed in the first instance for cases to be covered by Saiban-in trials, by type of offense (2002-2005) The number of persons finally disposed, which increased for two consecutive years, decreased slightly from the previous year in 2005. By type of offense, those finally disposed for robbery causing injury were the largest in number at 871 (27.0%), followed by those for homicide (24.6%) and those for arson of inhabited buildings (9.5%).With regard to the total number (3,629) of cases to be covered by Saiban-in trials which were newly accepted by district courts in 2005, when assuming the number of Saiban-in candidates per case as 50 to 100 persons, the number of Saiban-in candidates for all cases amounts to 181,450 to 362,900 persons, which accounts for 0.18 to 0.35% of the total number of registered eligible voters (102,985, 213 persons) as of September 11, 2005 (Source: The General Secretariat, Supreme Court). Fig. 6-5-5-3 shows the percent ratio of persons finally disposed in the first instance for cases to be covered by Saiban-in trials, by number of times of trials in 2005. Those for which trials were opened three times or less accounted for nearly 39% of the total. The average was 5.8 times, and trials took 8.3 months on average (Source: The General Secretariat, Supreme Court). As of April 30, 2006, judgment was rendered in the first instance for 35 cases to be covered by Saiban-in trials which were brought to Pre-trial Arrangement Procedure between November 1, 2005 and April 30, 2006.Fig. 6-5-5-4 shows the percent ratio of such cases by number of times of trials. By type of offense, those for homicide were the largest in number at 59, followed by those for robbery causing injury (27) and those for rape at the scene of a robbery (17). Three persons were sentenced to imprisonment with work for over 20 years but 25 years or less, one for homicide and two for robbery causing death.
