Imprisonment with/without work is executed in a penal institution under the direction of the public prosecutor.
Inmates are provided with correctional treatment, which includes work, guidance for reform, and guidance through school courses at penal institutions in order to raise the inmates' motivation to reform/rehabilitate themselves and to develop their ability to better adapt to social life. An offender who has defaulted in payment of a fine or petty fine is to be detained in a workhouse attached to a penal institution and to have work assigned (detention in workhouse in lieu of payment of fines).
The Act on Penal Detention Facilities and Treatment of Inmates and Detainees (hereinafter “Penal Detention Facilities Act,” Act No. 50 of 2005) stipulates the management and operation of penal institutions and the treatment of sentenced, unsentenced and other inmates.
