2 Benefits for recovery from damage

  The Act for Partial Amendment to the Act against Organized Crime (Act No. 86 of 2006) and the Act on Payment of Benefits for Recovery from Damage with Criminally Acquired Property, etc. (Act No. 87 of 2006) were enforced on December 1, 2006. In order to ensure confiscation of crime proceeds and further enhance protection of crime victims, these acts stipulate necessary matters as follows: [1] in regard to the property, etc. which an offender acquired from his/her crime victim through his/her property offense, etc. (criminally acquired property), it shall be made possible to implement confiscation of the property, etc./collection of a sum of equivalent value under certain cases, and apply the property, etc. to the benefits mentioned in [2], and [2] using the property, etc. obtained by confiscation of criminally acquired property/collection of a sum of equivalent value, benefits for recovery from damage shall be paid to the person who has suffered damage in property by the criminal act concerned.
