2 Trial

(1) Sentencing by type of offense

  Fig. 6-4-3-5 shows sentencing for rape in the court of first instance, over the last 30 years.

  The percentage of those who were sentenced to imprisonment with work for over five years has been on a rise, increasing from 3.7% in 1995 to 23.8% in 2005. Longer imprisonment with work has come to be sentenced these days, and the number of those sentenced to imprisonment with work for over 10 years increased from one in 1995 to 14 in 2005. The percentage of those granted suspension of execution of sentence has been declining, down from 36.8% in 1995 to 17.2% in 2005.
  Also with regard to rape causing death or injury, the percentage of those sentenced to imprisonment with work for over five years increased. Life imprisonment with work has come to be sentenced since 1999 and was sentenced to two persons in 2005. The percentage of those granted suspension of execution of sentence has also been declining, down from 31.5% in 1995 to 12.5% in 2005.

One case for which life imprisonment with work was sentenced
  The defendant committed two cases of rape causing injury (attempt of rape), four cases of attempted rape, and five cases of forcible indecency against 11 girls from three to 10 years of age (at the time of the case), over one year and five months.

  The number of those sentenced to long-term imprisonment with work has been increasing also with regard to forcible indecency, and forcible indecency causing death or injury.

(2) Revocation of suspension of execution of sentence

  Table 6-4-3-6 shows the number of offenders who had been convicted for rape or forcible indecency with suspension of execution of sentence but had his/her suspension of execution of sentence revoked, by reason, over the last five years.
  Table 6-4-3-7 shows the number of offenders who had been convicted for rape or forcible indecency with suspension of execution of sentence, but had his/her suspension of execution of sentence revoked, by period of time up to the date of repeat offenses (meaning the period of time between the date of rendition of the judgment and the date on which he/she committed another offense).
