2 The first instance

  Viewing the number of defendants finally processed in the first instance by district, family, and summary courts in 1998 by type of proceedings, 68,078 (6.3% of the total) were processed by ordinary proceedings and 1,018,474 (93.7%) by summary proceedings, showing the latter to be overwhelmingly in the majority.
  Table II-5 shows the number of defendants finally processed in the first instance by district and family courts in 1998, by type of offense and type of final classification.
  The number of defendants finally processed by district courts increased by 864 (1.5%) from the previous year to 57,523. By type of offense, the most numerous were Stimulant Drug Control Law violations (21.9% of the total), followed by road traffic violations (14.6%), larceny (11.3%), Immigration Control Law violations (8.2%), professional negligence (8.2%), and fraud (6.5%), in that order.
  The number of defendants finally processed in the first instance by family courts for adult criminal cases infringing on juvenile welfare decreased by 23 (8.8%) from the previous year to 239. Of these, 148 (96.1%) of the 154 defendants sentenced to imprisonment with labor were in violation of the Child Welfare Law, while 42 (49.4%) of the 85 defendants sentenced to fines or minor penalties were in violation of the Labor Standards Law.

  Table II-6 shows the number of defendants finally processed in the first instance by summary courts in 1998, by type of offense and type of final classification.
  The number of defendants finally processed by ordinary proceedings in summary courts increased by 1,067 (11.5%) from the previous year to 10,316. Of those sentenced to imprisonment with labor, 95.4% were for larceny, and of those sentenced to fines or minor penalties, 44.6% were for professional negligence or road traffic violations. Defendants punished with fines or minor penalties by summary proceedings decreased by 35,366 (3.4%) from the previous year to 1,018,474. By type of offense, the most numerous were road traffic violations (88.4% of all summary proceedings), followed by professional negligence (7.7%).
