Section 2  Public Prosecution and Trial

1 Previously convicted persons among those prosecuted

  Table 3-5-2-1 shows the number of persons previously convicted (those who had previously been sentenced to death penalty, imprisonment, or fine by final judgment; hereinafter the same in this section), their rate (percent ratio of persons previously convicted to all persons prosecuted; hereinafter the same in this section), and their status at the time of their offenses (under suspension of execution of sentence, on parole, or on bail), among the persons prosecuted (excluding for negligence in vehicle driving, etc. and violations of road traffic related acts, corporations, and those whose previous conviction records are unknown; hereinafter the same in this section) by type of major offense in 2007.

  By type of offense, the rate of previously convicted persons exceeded 60% for those convicted for Stimulants Control Act violations and Physical Violence Act violations.
  Among those previously convicted, the ratio of those who were under suspension of execution of sentence at the time of their offense to all prosecuted persons was the highest for embezzlement, followed by theft and Stimulants Control Act violations in that order.
