3 Discharge or continuation of hospitalization

  Discharge from and continuation of hospitalization in designated hospitals for inpatient care are decided by courts at hearings held upon application by the managers of designated hospitals for inpatient care.
  Managers of designated hospitals for inpatient care are required to apply every six months for confirmation of continuation of hospitalization of those hospitalized upon decision of hospitalization, and for discharge from the hospital if it is deemed unnecessary for them to remain hospitalized and receive medical care. In addition, those hospitalized upon decision of hospitalization and their guardians or attendants can apply for permission to be discharged or termination of medical care at any time.
  In 2008, 156 applications for permission to be discharged were filed by managers of designated hospitals for inpatient care, and 46 applications for permission to be discharged from a hospital/termination of medical care were filed by inpatients, etc. 115 received the decision of being discharged from the hospital (decision to allow the person to be discharged from the hospital and have him/her receive outpatient treatment; hereinafter the same in Subsection 4) and 27 received the decision of termination of hospitalization.
