4 Guidance and advice concerning victims We examined the feelings of victims'bereaved families based upon the survey which was carried out during environmental adjustment or probationary supervision,and also made research on guidance and advice on how to deal with victims,etc.provided for probation office survey object person. Surveys of victims,etc.were conducted for15juveniles(17.4%)in total(surveys were not conducted for Family Type cases where victims are family members)while they were accommodated in correctional institutions or placed under probationary supervision.Among guidance and advice with a view to victims,that for"praying for the souls of victims"was provided in a relatively high rate(70.9%),followed by that for"teaching juveniles how to behave,such as putting themselves in victims'positions"(57.0%),that for"offering apologies"(50.0%),and that for"compensating financially"(36.0%).The percentage of"probation officers or volunteer probation officers accompanying juveniles when they go to offer apologies"was5.8%. The following are concrete examples of guidance on how to deal with victims,etc.by classification type of offenses.
(i) A case where a juvenile,who committed injury resulting in death,went to the bereaved family's house to offer in cense to the victim on monthly observance(a Group Type male) The juvenile and his accomplices lynched the victim,who tried to leave the hot rodders group,and killed him. He did not use violence himself toward the victim at the time of offense.After attendance in the education at a juvenile training school,he said,"I did not use violence,but our presence at the time of offense scared the victim,depriving him of courage to escape.I am equally guilty as the other perpetrators who actually killed him."As financial compensation was left to the lawyer who was hired by his parents,the probation office which was in charge of his probationary supervision provided guidance and advice on how to pray for the soul of the victim and how to offer apologies to the bereaved family.The advice was as follows:"you should go to apologize timely,but you need to prioritize the bereaved family's feelings and convenience,""your parents should also accompany you and apologize for you,"and"you must show your sincerity and repentance,"etc.Based on such guidance,he went to offer apologies right after he was released on parole from a juvenile training school.With the bereaved family's consent,he has continued to visit their house with his parents to offer incense to the victim on every monthly observance.
(ii) A case of a juvenile who killed a homeless person who happened to be passing(a Single Type male) The juvenile was chased by a homeless person who happened to be passing,the victim,in a park and scuffled with him.The juvenile stabbed the victim with a knife he was carrying,and killed him by blood loss. His parents offered apologies to the victim's relative and paid a solatium.The victim's relative submitted a written statement to a family court,asking for clemency.After he was released on parole from a juvenile training school,the probation office took into consideration the fact that he usually carried a knife as he used to be bullied and was apt to be truant.Based on these facts,the probation officer who was in charge of him advised him not to carry a knife carelessly and try to adapt himself to social life by setting goals.The probation office provided him with practical guidance and advice,based on the facts of envisioned specific troubles,with regard to appropriate ways to deal with confusion or troubles.
(iii) A case of a juvenile,who committed infanticide,advised on how to pray for the soul of the baby(a Family Type female) A female juvenile got pregnant through a love affair with a man with whom she got acquainted through cell-phone text-messaging.She could not take appropriate measures and killed her baby that she delivered at home. As a part of guidance for respecting human life,the probation officer and the volunteer probation officer who were in charge of her advised her to pray every day at a Buddhist altar where an ancestral tablet of the victim is enshrined.She offered sweets in front of the tablet and visited temples to pray for the victim.Her parents,who had given no attention to her disordered life style until the incident,changed their attitude to think about the importance of life with her,inviting a monk at home to hold a memorial service on yearly observance.
(iv) A case of a juvenile,who committed unsafe driving resulting in death,granted a good-conduct award because the bereaved family's emotions were cured(a Traffic Type female) A juvenile hit a passenger,the victim,and killed him by unsafe driving at high speed. He was referred to a public prosecutor from a family court,sentenced to imprisonment without suspension of execution of sentence,served the term,and got released on parole.His parents showed a positive attitude for accepting and supervising him while he was imprisoned,and made compensation in a sincere manner.As a result of the survey of victims,etc.,emotions of the bereaved family seemed to have been cured.The juvenile continued employment and maintained good behavior during probationary supervision,and was granted the termination of sentence before the original term of sentence as a good-conduct award.
