5 Suspension of execution of sentence

(1) Suspension of execution of sentence

  Over the last ten years,suspended execution rate for imprisonment with labor has remained within the range of60to65%and the rate for imprisonment without labor has basically remained within the range of90to95%.(see Table2-3-2-1 )

(2) Revocation of suspension of execution of sentence

  Table2-3-3-4 shows the number of offenders whose suspension of execution of sentence was revoked over the last five years.
  In2004,7,431offenders had their suspension of execution of sentence revoked,an increase of1.8%from the previous year.An overwhelming majority of the6,974were revoked for new convictions of imprisonment for a repeat offense.
  Since the persons who were granted suspension of execution of sentence in a given year and those whose suspension of execution of sentence was revoked in that year are of two different target groups,it is not possible to calculate the revocation rate in a strict sense.However,by finding out the percentage of the latter compared to the former,it is possible to observe a rough trend of revocation of suspension of execution of sentence for that year.
  In2004,the percentage of those who had their suspension of execution of sentence revoked compared to those of suspensions granted(D/A%)was13.1%.By type of offense,Stimulants Control Law violations were the highest with29.8%,followed by larceny with22.3%.The percentage of revocation due to a new conviction of imprisonment for those under probationary supervision(F/C%)was26.7%.By type of offense,Stimulants Control Law violations were the highest with40.6%,followed by larceny with31.8%,and extortion with28.4%(Source:Annual Report of Statistics on Prosecution).
