2 Adjudication by courts

  In1998,2,231persons were sentenced to imprisonment with labor for professional negligence by ordinary first instance courts, and2,247persons were sentenced to imprisonment without labor. By term of sentence, imprisonment for less than six months accounted for3.5%and0.4%, imprisonment for six months or more but less than one year accounted for36.6%and15.2%, imprisonment for one year or more but less than two years accounted for51.3%and79.6%, and imprisonment for two years or more accounted for8.6%and4.8%, respectively.23.8%of the persons sentenced to imprisonment with labor as well as6.1%of those sentenced to imprisonment without labor were not granted suspension of execution of the sentence. In addition,114persons were given fines by ordinary first instance courts, and78,068persons were fined in summary proceedings in1998.
  8,292persons were sentenced to imprisonment with labor(including1,428persons without suspension of execution)for road traffic violations by ordinary first instance courts in1998. By term of sentence,6,942persons(83.7%)were sentenced to imprisonment for less than six months,1,318persons(15.9%)for six months or more but less than one year, and30persons(0.4%)for one year or more but less than two years. In addition,311persons were given fines by ordinary first instance courts and900,154persons were fined(including minor fines)in summary proceedings for road traffic violations(source:Annual Report of Judicial Statistics).
