Chapter2 Consideration for Victims in Criminal Justice

Section1 Criminal Proceedings and Victims

  As for measures for crime victims,the Law for Partial Amendment to the Code of Criminal Procedure and the Law for the Inquest of Prosecution(Law No.74of2000,enforced from June in2000to June in2001)and the Law Concerning Measures Accompanying Criminal Proceedings to Protect Crime Victims,etc.(Law No.75of2000,enforced in November in2000)were promulgated.In addition,the Basic Law for Crime Victims,etc.(Law No.161of2004)enacted on December1,2004,and was enforced on April1,2005,in order to promote comprehensive and systematic policies for crime victims.
  The Basic Law for Crime Victims,etc.has the basic philosophy of respecting the dignity of individual crime victims,etc.,and taking measures that enable victims to receive appropriate and continuous support necessary to resume a peaceful life according to their individual circumstances.It stipulates that the government is responsible for establishing and implementing comprehensive measures for crime victims,etc.based on the basic philosophy,and that the local authorities are responsible for establishing and implementing measures for crime victims,etc.based on the basic philosophy,with appropriate sharing of roles with the government.Furthermore,it defines that the people also have a responsibility to pay full attention not to bring dishonor on victims or damage their peaceful life,and to offer cooperation as measures for them.This law also stipulates that the government should establish a basic plan for crime victims,etc.,which defines the outline of long-term comprehensive policies for crime victims,etc.,in order to promote the policies comprehensively and systematically.At present,the plan is under discussion,aiming for completion in December2005.
