Section 2 Treatment of Traffic Offenders

1 Dispositions by public prosecutors offices

  Trends in prosecution and suspended prosecution rates for traffic professional negligence in the20-year period since 1980indicate an upward movement in the suspended prosecution rate and a downward trend in the prosecution rate. In1999,the suspended prosecution rate and prosecution rate stood at87.8%(up1.0point from the previous year)and12.0%(down0.9points), respectively.
  As regards road traffic violations, the prosecution rate has continued to exceed 90% while the suspended prosecution rate has fluctuated between the 2% and 6% ranges( see Part2, Section2-4 ).
  Fig. IV-17 shows the composition of final dispositions by public prosecutors offices in1999for general incidents and traffic incidents. The ratio of prosecution for formal trial is lower for traffic professional negligence and road traffic violations than for general incidents. As regards road traffic violations, the ratio of prosecution for summary proceedings is very high, while the ratio of non-prosecution(suspended prosecution in most cases)is low.
