2 Dispositions made by public prosecutors offices and by courts

  Fig.1-3-6-4 shows the percent distribution of dispositions for Firearms and Swords Control Law violations made by public prosecutors offices over the last10years.
  Fig.1-3-6-5 shows the term of imprisonment with labor sentenced in the court of first instance for Firearms and Swords Control Law violations over the last10years.

  The term of imprisonment sentenced in the court of first instance in2004for violations of the Firearms and Swords Control Law and the Manufacture of Weapons,etc.Law(Law No.145of1953)with regard to handguns,etc.(handguns,rifles,machine guns,and cannons;hereinafter the same),a total of114persons were sentenced to imprisonment with labor(including32persons who were sentenced with suspension of execution of sentence).Breakdown of them is as follows:five were sentenced to10years and over,nine persons to seven years and over but under10years,13persons to five years and over but under seven years,44persons to three years and over but under five years,42persons to one year and over but under three years,and one person to under one year.By type of incident,63persons were convicted for"possession of handguns and live ammunition"(among them,52persons were convicted for aggravated possession),21persons for"simple possession of handguns",and15persons for"firing"(Source:The Criminal Affairs Bureau,Ministry of Justice).
  In2004,18persons'punishments were reduced due to submitting handguns and surrendering themselves voluntarily to the police.15of them were related to organized crime groups(regular or quasi-members of a group which might commit illegal violent acts habitually or as a group;hereinafter the same in this Section),and three were persons other than organized crime group members.In2004,62persons were granted suspension of prosecution due to submitting handguns and surrendering themselves to the police;among them,19persons were organized crime group members and43persons were other than those members(Source:The Criminal Affairs Bureau,Ministry of Justice).
