2 Discussion of new systems for preventing repeat offenses, etc.

(1) Study and deliberation by the Legislative Council

  In response to a request for advice from the Minister of Justice, the Legislative Council is currently engaged in a study and deliberation on the following systems.
  a. System to make social contribution activities a special condition for probation/parole supervision
  In order to further enhance treatment in probation/parole supervision and facilitate reformation / rehabilitation / repeat offense prevention of offenders, this system will make social contribution activities a special condition for probation/parole supervision.
  b. System to partially suspend execution of the sentence
  In order to coordinate institutional treatment with community-based treatment more appropriately and facilitate the reformation / rehabilitation / repeat offense prevention of offenders, the system will enable a court rendering a judgment of imprisonment with or without work to partially suspend execution of the sentence and, if necessary, impose probation during the suspended period. This will make it possible to suspend the execution of the remaining portion of sentence after the completion of a certain term of imprisonment with or without work and implement probation/parole supervision during the suspended period.

(2) Studies that contribute to the discussion of preventive measures against repeat offenses

  The Action Program 2008 listed the feasibility of using GPS devices in preventive measures against repeat offenses as one of the issues to be discussed. In response to this, the Ministry of Justice is planning to conduct research from a broad point of view on systems that provide information on the location of offenders using GPS devices, etc., currently implemented in other countries.
