Section 6 State of Trials and Sentencing in Cases Involving Aum Shinrikyo Cult Members

  Formal trials have been requested for 189 persons in connection with the series of cases allegedly involving Aum Shinrikyo cult members, including the Sarin gas attacks in the Tokyo subway system on March 20, 1995. As of June 30, 2003, sentences have been handed down to 186 of these defendants in the first instance, while the trials for the other 3 are still pending in the first instance. Of those who have been sentenced, 170 have received final judgment. More specifically, 166 have been sentenced to imprisonment with labor, 79 of which have been imprisoned without suspension of execution of sentence and 87 (including 2 found partially not guilty) have been given suspension of execution of sentence, 3 sentenced to fine and 1 found not guilty. Death penalty has been handed down to 9 defendants. 11 defendants, including these 9, are awaiting Koso appeal judgments and 5 others awaiting Jokoku appeal judgments (Source: Data by Criminal Affairs Bureau, Ministry of Justice).

Suspended execution rate: This is an indication of the following in percentage: number of offenders given suspension of execution of sentence (imprisonment with or without labor for a limited term) / number of those found guilty (imprisonment with or without labor for a limited term).
