2 The first instance

   Table 2-3-2-2 shows the number of defendants finally disposed in the first instance by district and family courts in 2001, by type of offense and type of final disposal. Table 2-3-2-3 shows the number of defendants finally disposed in the first instance by summary courts in 2001, by type of offense and type of final disposal.

  Viewing the number of defendants finally disposed in the first instance by district, family and summary courts by type of proceedings in 2001, 81,503 (8.4% of the total) were disposed by ordinary proceedings and 891,792 (91.6%) were by summary proceedings. Thus, an overwhelming majority of defendants were disposed by summary proceedings.
  The number of defendants finally disposed by district courts increased by 3,099 (4.6%) from the previous year to 70,260 in 2001. By type of offense, most defendants were disposed for Stimulant Drug Control Law violations (20.2% of the total), followed by road traffic violations (12.9%), larceny (12.5%), and bodily injury caused by negligence (9.5%), in that order.
  The number of defendants finally disposed in the first instance by family courts for adult criminal cases against the welfare of juveniles increased by 42 (18.5%) from the previous year to 269 in 2001. Among the 51 defendants who were sentenced to fines or minor fine s, 35 (68.6%) were for Child Welfare Law violations and 16 (31.4%) for Labor Standards Law violations. Most of those sentenced to imprisonment with labor (98.6%) were for Child Welfare Law violations (Source: Annual Report of Judicial Statistics).
  The number of defendants finally disposed by summary courts by ordinary proceedings decreased by 88 (0.8%) from the previous year to 10,974 in 2001. Most of the defendants sentenced to imprisonment with labor (95.2%) were for larceny and about half of the defendants sentenced to fines (46.6%) were for bodily injury and road traffic violations. The number of defendants sentenced to fines or minor fines by summary proceedings decreased by 21,718 (2.4%) from the previous year to 891,792. By type of offense, most of these defendants were convicted of road traffic violations (84.6% of the total defendants disposed by summary proceedings).
