4 Narcotics Special Provision Law violations

The Law Concerning Special Provisions for the Narcotics and Psychotropics Control Law, etc. , and Other Matters for the Prevention of Activities Encouraging Illicit Conducts and Other Activities Involving Controlled Substances Through International Cooperation(hereinafter referred to as the"Narcotics Special Provision Law"), enacted in1991,provides for the punishment of illegal import or other acts conducted as business, the punishment of money laundering(concealment, disguise and acceptance of earnings derived from drug offenses, etc. ), the mandatory confiscation of earnings derived from drug offenses and the collection of the equivalent amount to be confiscated, as well as arrangements for international controlled delivery.
  According to the Annual Report of Statistics on Prosecution, data for the last five years indicate that the number of persons newly received by public prosecutors offices for Narcotics Special Provision Law violations was17in1995,43in1996,61in1997,51in1998and51in1999. In accordance with the law, confiscation was applied to21cases in1999,amounting to¥73,341,671,while a total of¥1,823,279,919was collected as the equivalent amounts to be confiscated for267cases(see Appendix IV-1 ).
  Controlled delivery was applied to24cases in1995,19cases in1996,19cases in1997,29cases in1998and19cases in1999(source:Community Safety Bureau, National Police Agency).
